Bis zum 3. July 2009 sind bisher ca. 45.000 Anträge für H-1B Visa beim US Citizenship and Immigration Services (USCIS) eingegangen, wobei ca. 20.000 Anträge durch die ‚Advance Degree Cap Exemption‘ unter die Cap Befreiung fallen. Der USCIS akzeptiert weiterhin H-1B Anträge, die dem „Cap“ unterliegen, wie auch diejenigen die vom „Cap“ befreit sind, bis die zugrundeliegenden Grenzwerte erreicht worden sind.

Update as of 09/30/09 from the USCIS H-1B Cap Updage webpage:
„As of September 25, 2009, approximately 46,700 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn.“
In other words, over 30% of the available H-1B visas remain, after the first six months of activity.
